Terms of Service

1. Acceptance of Terms
These Terms of Service (the “Terms”) govern your access to and use of the GymText service operated by GymText LLC (“GymText”, “we”, “us”), available at gymtext.co. By creating an account, enrolling in a program, or receiving SMS messages from GymText, you agree to these Terms and to our Privacy Policy.
2. Service Description
GymText delivers personal training and fitness coaching by SMS text message. After enrolling in a program authored by an independent coach or trainer on the GymText platform, you receive a daily workout message via text at the local time you select during signup. There is no app or dashboard required — the service is delivered entirely by SMS.
3. Subscriptions, Billing, and Cancellation
Some programs are offered free of charge; others are paid recurring subscriptions billed monthly through our payment processor (Stripe). The price for each program is shown on its signup page before checkout. You may cancel a paid subscription at any time from your account or by emailing support@gymtext.co. Cancellation stops future billing; previously paid amounts are non-refundable except where required by law.
For under-13 enrollments where a parent has not approved within 14 days of signup, we automatically cancel the subscription and refund the first invoice (see Section 5.3 below).
4. User Eligibility and Capacity
GymText is offered to athletes 10 and up. Different account types apply at different ages:
- Adults (18 and up). An adult may sign up for themselves and agrees to these Terms on their own behalf.
- Teens (13–17). A teen may sign up for themselves but the account is not activated and no SMS messages are sent until the teen’s parent or legal guardian approves the enrollment by clicking the link we email them. By approving, the parent/guardian agrees to these Terms on the teen’s behalf and confirms that the teen has capacity to receive coaching messages.
- Children under 13. A child under 13 cannot create their own GymText account. A parent or legal guardian enrolls the child on the child’s behalf and agrees to these Terms on behalf of the child. See Section 5.
If a parent or guardian is enrolling a minor and is themselves under 18, they must have legal capacity to enter into these Terms in their jurisdiction. We may decline or terminate accounts where capacity cannot be reasonably established.
5. Parental Consent and Under-13 Enrollment
For athletes under 13, the Children’s Online Privacy Protection Act (COPPA) requires verifiable parental consent before we collect any personal information from the child. We obtain that consent through one of two FTC-approved methods, described below.
5.1 Paid programs — consent through payment
For paid programs, the parent’s Stripe payment is our verifiable consent record (16 CFR § 312.5(b)(2)(ii)). The Stripe receipt and our internal consent row together constitute the parent’s consent.
5.2 Free programs and teens — consent through email link
Free programs are not available for athletes under 13. For the teen flow (13–17), we send a signed approval link to the parent’s email. The parent’s click is the consent action and is timestamped (16 CFR § 312.5(b)(2)(iv)).
5.3 14-day window and automatic cancellation
If the parent does not click the approval link within 14 days of signup, we automatically cancel the enrollment, refund the first invoice in full (paid path), and email both parties to confirm. We do not store or use any of the child’s information collected during a cancelled signup beyond the audit log of the cancellation itself.
5.4 Parental rights
A parent or legal guardian may, at any time, request that we review, delete, or stop collecting their child’s personal information. Email admin@gymtext.co. We respond within 14 days. Deletion of a child’s account terminates the enrollment.
5.5 Age-up
When a child reaches their 13th birthday, we email the parent a claim link the child can use to set up their own GymText account. When a teen reaches 18, parental consent is automatically revoked and the user owns their own account on the same terms applicable to adult users.
6. SMS Program Terms
The following is a summary of the GymText SMS program. The remainder of this Section 6 contains the complete terms.
- Program name: GymText.
- Program operator and SMS sender: GymText LLC.
- Program description: personalized fitness and workout coaching delivered by SMS.
- Message types: a one-time welcome message at signup, recurring daily workout messages, conversational coaching replies to messages you send us, and occasional re-engagement or next-program messages.
- Message frequency: approximately one message per day at the local time you select during signup, plus replies to messages you send us. There are no promotional blasts. Message frequency may vary.
- Cost: GymText does not charge a per-message fee. Standard message and data rates from your wireless carrier may apply.
- Opt out: reply STOP (or OPTOUT, CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE, STOPALL) to any message we send.
- Resume: reply START (or UNSTOP, SUBSCRIBE).
- Help: reply HELP or INFO for an auto-reply with unsubscribe instructions, or email support@gymtext.co.
- Opt-in walkthrough: /opt-in shows the full signup flow with screenshots and the exact consent language.
By providing your mobile number and checking the SMS-consent box on the signup form, you expressly consent to receive recurring automated fitness and workout text messages from GymText at that number. You will receive approximately one workout message per day at the local time selected at signup, plus occasional conversational replies to messages you send us. Message frequency may vary. Message and data rates may apply.
For under-13 enrollments, the parent provides their own phone number; daily messages are addressed to the child but delivered to the parent’s device. The child does not provide a phone number.
The SMS-consent checkbox on the signup form displays this language verbatim:

You may opt out of SMS messages at any time by replying any of the following keywords to any message you receive from us: OPTOUT, CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE, STOP, STOPALL. To resume messages after opting out, reply START, UNSTOP, or SUBSCRIBE. For help, reply HELP or INFO to receive an auto-reply with unsubscribe instructions, or email support@gymtext.co.
Message delivery is not guaranteed and depends on your wireless carrier and network conditions. GymText is not liable for messages that are delayed, undelivered, or delivered out of order due to carrier or device factors outside our control. Supported US carriers include AT&T, Verizon, T-Mobile, and their MVNO and regional partners.
GymText operates this SMS program in accordance with the Telephone Consumer Protection Act (TCPA), the CTIA Messaging Principles and Best Practices, and the A2P 10DLC requirements of the US wireless carriers.
7. Acceptable Use and No Medical Advice
GymText provides general fitness content and is not a substitute for professional medical advice, diagnosis, or treatment. Consult a qualified healthcare provider before beginning any new exercise program, especially if the athlete has a pre-existing medical condition, is pregnant, or has any concerns about their ability to safely complete the workouts. You assume all risk associated with participating in any workout you receive through the service. For minor athletes, the parent or legal guardian assumes this risk on the minor’s behalf.
You agree not to use the service for any unlawful purpose, not to share or resell the workout content, and not to attempt to interfere with the operation of the service or its messaging infrastructure.
8. Coach and Program Content
Programs available on the GymText platform are authored by independent coaches and trainers. GymText operates the messaging platform and is the sender of all SMS messages, but the workout content and program structure are the responsibility of the coach or trainer who authored the program. Inclusion of a program on the platform is not an endorsement of the coach’s qualifications or the safety or effectiveness of any specific workout.
9. Limitation of Liability
To the maximum extent permitted by law, GymText, its affiliates, and its coaches are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of (or inability to use) the service. Our total aggregate liability for any claim arising out of or relating to these Terms is limited to the amount you paid GymText in the twelve months preceding the claim.
10. Changes to These Terms
We may update these Terms from time to time. If we make a material change, we will update the “Last updated” date at the top of this page and, where appropriate, notify you by SMS or email. Your continued use of the service after the changes take effect constitutes acceptance of the updated Terms.
11. Governing Law and Contact
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules. Questions about these Terms can be sent to support@gymtext.co. For matters concerning a child under 18, email admin@gymtext.co.
